Nobody can be forced to take COVID19 vaccines: SC

A Supreme Court bench comprising of Justices L Nageswara Rao and BR Gavai ruled that nobody can be forced to take COVID19 vaccines.

In their ruling, the judges said that bodily autonomy and integrity are constitutional rights and no individual can be forced to get vaccinated against COVID19.

“Considering bodily autonomy, bodily integrity is protected under article 21. No one can be forced to get vaccinated. (But) government can regulate in areas of bodily autonomy,” the court said.

The SC said that as long as COVID numbers are low, restrictions on unvaccinated individuals in relation to access to public places and resources are unreasonable and suggested that the states remove such restrictions.

The bench said that it is satisfied that the current vaccine policy cannot be said to be unreasonable and manifestly arbitrary.

The SC also directed the central government to make public the data on the adverse effects of COVID19 vaccination.
