Rape in Asha Kiran Home: Notice to Delhi Govt.

The National Human Rights Commission (NHRC) has issued notice to the Delhi government on social activist Raj Hans Bansal's complaint. Mr Bansal had informed the NHRC that a 19-year-old mentally retarded woman was raped during her detention in Delhi Government’s Asha Kiran Home in Rohini and she became pregnant.

In the notice, the Commission ordered the secretary, Department of Social Welfare, Delhi Government, to register an FIR against the accused and that investigation of the case be carried out expeditiously.

It further ordered to ensure safety and protection of the victim and other female inmates of the Home and called for a detailed report in the matter within four weeks, along with details of the FIR.

Pursuant to the directions of the Commission, a team comprising of Bimal Jit Uppal, M Uppal and Deepak Kumar Yadav of investigation division along with Dr Ruchi Verma, clinical psychologist-IHBAS, Psychiatrist Dr Padmini and Dr Monika Gupta, associate Prof, Gynecology conducted an enquiry from November 18-26, 2019.

According to the report, the accused, as indicated by the victim, was identified as Abdul@ Kamal Gunga, who was detained in Asha Kiran Home on February 2, 2019.

Dismissing the report, Mr Bansal argued that innocent person was framed in the case while the mastermind were left out.

In his complaint, Mr Bansal reported that the pregnancy of the woman was aborted at Baba Saheb Amedkar Hospital, Delhi, by the authority of the Home on January 30 last year.

Mr Bansal alleged, “The incident is shocking, giving true picture of the Delhi Government’s infrastructure and maintenance of the shelter homes.”
